Terms of Service

Effective date: July 23, 2025

These Terms of Service ("Terms") constitute a legally binding agreement between the customer ("you" or "traveller") and Trine Trip ("we," "us," or "our"), a travel facilitation service based in Delhi, India. These Terms govern your access to and use of our services offered through the website and authorized communication channels. By submitting a travel query, confirming a booking, or making any payment to Trine Trip, you expressly agree that you have read, understood, and unconditionally accepted these Terms in full. These Terms shall apply to all bookings made with us and shall be deemed accepted unless expressly modified by mutual written agreement signed by all relevant parties.

1. Definitions

  • "Customer" or "Traveler": The individual who submits a travel query, makes a payment, or uses Trine Trip services.
  • "Trine Trip": The service provider facilitating customized travel experiences through third-party vendors.
  • "Vendor(s)": Independent third-party service providers engaged for hotels, transfers, guides, and other package elements.
  • "Force Majeure": Events beyond reasonable control, including but not limited to natural disasters, strikes, riots, acts of war, pandemics, or government restrictions.
  • "Confirmed Booking": A travel package that has been accepted by Trine Trip and paid for in full by the Customer.

2. Booking Process

Bookings must be initiated through our website query form, WhatsApp, email, or direct call. Valid government-issued identification (Aadhaar, Passport, or Voter ID) is mandatory for all travellers. You confirm that all data shared is true and accurate. Trine Trip reserves the right to decline or cancel bookings based on false, incomplete, or unverifiable information.

3. Service Description & Disclaimers

Trine Trip offers curated and personalized travel experiences which may include accommodations (with breakfast), local transfers, itinerary planning, and optional guide services. Flight and train bookings are expressly excluded from our scope. We are not a tour operator or licensed travel agent under applicable law. Our role is that of a travel facilitator and coordinator, working to ensure a seamless and enriching experience by partnering with independently contracted, best-in-class service providers. Each vendor—whether for lodging, local transportation, or guiding—is carefully vetted for reliability, service quality, and customer satisfaction before being included in your itinerary.

While we make every reasonable effort to engage competent and reputable vendors and to coordinate logistics professionally, the actual delivery of services is carried out by third-party entities. As such, Trine Trip cannot and does not guarantee or warrant the suitability, safety, punctuality, or performance of such third-party services. You acknowledge and agree that any issues arising from the conduct or service quality of these vendors shall lie directly with them and not with Trine Trip.

4. Third-Party Vendor Disclaimer

Vendors are solely responsible for their services. Trine Trip does not control their operations and shall not be held liable for any delay, deficiency, damage, or negligence on their part. Any claims, disputes, or redress related to third-party services must be raised directly with the Vendor concerned.

5. Pricing & Payment Terms

All prices displayed or communicated by Trine Trip, whether via email, query form, or any other medium, are indicative and subject to confirmation. The final package price shall be determined based on prevailing third-party vendor rates, availability, seasonality, destination-specific surcharges, and any customizations requested by the Customer.

The final pricing shall be communicated to the Customer in writing (via email or WhatsApp) prior to confirmation, and no booking shall be deemed valid or binding until full payment of the final price has been received by Trine Trip. All payments shall be made in Indian Rupees (INR) and are inclusive of applicable taxes such as Goods and Services Tax (GST), unless otherwise specified in writing.

Trine Trip reserves the right to adjust pricing due to:

  • Sudden changes in vendor rates or service availability
  • Government-imposed levies, entry fees, or tax revisions
  • Customer-requested changes post-quotation
  • Currency fluctuations for international packages

Accepted payment methods include UPI, bank transfers, and credit/debit cards. Partial payments or instalment options shall be extended only if expressly agreed upon in writing. Any delay or failure to make timely payment may result in automatic cancellation of the booking without further notice. Trine Trip shall not be liable for any booking delays or losses arising due to incomplete, delayed, or failed payment transactions.

6. Cancellations, Rescheduling & Refunds

Customer-Initiated: Cancellations must be made in writing. For travel packages booked at least forty-five (45) days in advance of the scheduled departure date, the following tiered cancellation and refund structure shall apply, provided the cancellation request is made in writing and acknowledged by Trine Trip:

  • Cancellations made 30+ days before departure: eligible for 100% refund of the total booking amount, subject to deduction of applicable processing charges (if any)
  • Cancellations made between 20 and 30 days before departure: eligible for 90% refund, subject to applicable deductions
  • Cancellations made between 10 and 20 days before departure: eligible for 50% refund, subject to applicable deductions
  • Cancellations made less than 10 days before departure: no refund shall be issued under any circumstances

This advance booking refund policy applies only to complete package cancellations and does not cover partial modifications, add-ons, or rescheduling, which shall be governed separately based on vendor policies and actual incurred costs.

For travel packages booked less than forty-five (45) days in advance of the scheduled departure date, refunds will depend on the cancellation schedule provided at the time of booking. Processing fees may apply.

No refund will be given in the case of:

  • No-shows at the departure point
  • Missed buses or transfers due to personal delays
  • incomplete travel documents

Company-Initiated or Force Majeure: In case of natural disasters, weather-related roadblocks, or other Force Majeure events:

  • No refunds will be issued
  • Missed nights or emergency stays will be charged additionally
  • Emergency arrangements may be offered at your cost
  • Partial itinerary skips will not result in refunds

Refunds, if applicable, processed within 30 business days from written acknowledgment.

7. Change in Itinerary

Trine Trip reserves the right to modify itineraries, change hotels or vehicles, or alter activities due to safety concerns, operational needs, or Vendor issues. These decisions will be taken with your best interest in mind. No compensation shall be claimed for such changes.

8. Force Majeure

In the event of any Force Majeure occurrence, Trine Trip shall not be held liable for any failure to perform, or for any delay in the performance of, its obligations under the confirmed booking. "Force Majeure" shall include, but not be limited to, acts of God, natural disasters, fire, floods, landslides, severe weather conditions, pandemics, epidemics, quarantines, strikes, lockouts, war, civil unrest, governmental orders or travel restrictions, or any other event beyond the reasonable control of Trine Trip which renders the performance of contractual obligations impossible or impracticable.

Where a Force Majeure event materially affects the ability to deliver the agreed services, both parties shall be discharged from any further obligations under the confirmed booking without liability. The Customer shall remain responsible for any costs already incurred or committed to third-party vendors prior to the Force Majeure event. This clause shall operate without prejudice to any refund policy that may be separately communicated, and it is strongly advised that the Customer obtains suitable travel insurance to mitigate such risks.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Trine Trip's total liability—whether arising in contract, tort (including negligence), equity, or otherwise—shall be strictly limited to the actual amount received from the Customer for the specific portion of services directly affected. Under no circumstances shall Trine Trip be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to emotional distress, mental anguish, loss of enjoyment, loss of business or professional opportunities, missed connections, alternate bookings, or delays caused by third-party service providers, even if Trine Trip has been advised of the possibility of such damages. For clarity, the maximum cumulative liability of Trine Trip under any booking shall in no event exceed the total amount paid by the Customer for that particular booking or service component, regardless of the nature or number of claims asserted. This limitation shall survive the termination or cancellation of any agreement or booking and shall apply notwithstanding any failure of essential purpose of any limited remedy.

10. Customer Responsibilities

By engaging Trine Trip's services, the Customer expressly agrees and undertakes to:

  • Cooperate fully with all third-party service providers (including hotel staff, transport personnel, and guides) to ensure smooth execution of the itinerary;
  • Conduct themselves with respect, courtesy, and cultural sensitivity toward fellow travellers, vendors, and local communities at all times;
  • Adhere to all scheduled timelines, including hotel meal timings, check-in/check-out deadlines, and transport reporting times, and not cause avoidable delays or disruptions;
  • Take full responsibility for safeguarding all personal belongings and valuables during the course of travel. Trine Trip shall not be held liable for any loss, theft, or damage to personal property;
  • Settle directly with the vendor for all incidental or personal expenses including, but not limited to, early check-in/late check-out, room upgrades, minibar usage, laundry services, or other add-ons not included in the confirmed package;
  • Refrain from circumventing Trine Trip by directly approaching or engaging vendors introduced or coordinated by Trine Trip, either during or after the engagement, for any service quoted, proposed, or facilitated by Trine Trip;
  • In the event of any misconduct, unlawful behaviour, non-cooperation, or breach of these responsibilities by the Customer, Trine Trip reserves the right to immediately terminate the Customer's participation in the itinerary without refund or further liability.
  • The Customer shall be solely liable for any damage, loss, or disruption caused to third-party property, personnel, or services arising out of their conduct. The Customer further agrees to fully indemnify and hold harmless Trine Trip against any claims, losses, costs, damages, penalties, or legal proceedings initiated by vendors, authorities, or third parties as a consequence of such breach or misconduct.

11. Travel Documentation

It is your sole responsibility to carry:

  • A valid government-issued ID (Aadhaar, Voter ID, Passport)
  • Visa or entry permits (if required)
  • Travel insurance documentation (recommended)

Trine Trip disclaims liability for denied entry, visa refusals, or deportation.

12. Insurance and Risk

We highly recommend that all travellers obtain travel insurance that includes trip cancellation, baggage loss, emergency medical care, and weather-related disruptions. Travel is inherently risky, and Trine Trip shall not be liable for losses arising from unanticipated events or uninsured risks.

13. Intellectual Property & Content Usage

All itineraries, graphics, content, logos, and documents created by Trine Trip are protected intellectual property. You agree not to copy, distribute, or use them for any purpose other than your personal travel experience. Trine Trip uses assets from licensed open-source libraries with attribution where required.

14. Data Collection & Privacy

Trine Trip collects personal data solely for booking and communication purposes. We do not maintain user logins or accounts. Data is stored securely and only shared with Vendors on a need-to-know basis. We do not sell, rent, or misuse customer data. Please refer to our Privacy Policy for detailed disclosures.

15. Grievance Redressal & Dispute Resolution

In the event of any concern, complaint, or dispute arising out of or in connection with these Terms or the services rendered by Trine Trip, the Customer shall first raise the grievance in writing through the contact form on the Trine Trip website or via email. Trine Trip shall make reasonable efforts to resolve such grievance amicably within forty-five (45) business days from the date of receipt.

If the matter remains unresolved, the parties agree to attempt resolution through formal mediation to be conducted under the auspices of the Delhi International Arbitration Centre (DIAC) in accordance with its Mediation Rules. The mediation shall be conducted in English at New Delhi, and each party shall bear its own costs unless otherwise agreed.

In the event, that mediation fails to resolve the dispute within thirty (30) days from its commencement, the dispute shall be referred to and finally resolved by arbitration administered by the DIAC, in accordance with its Arbitration Rules, which are deemed to be incorporated herein by reference. The arbitration shall be conducted by a sole arbitrator appointed in accordance with the said rules. The seat and venue of arbitration shall be New Delhi, and the proceedings shall be conducted in the English language. The arbitral award shall be final, binding, and enforceable upon the parties.

These Terms, and all rights and obligations arising hereunder, shall be governed by and construed in accordance with the laws of India. Subject to the foregoing, the courts at Delhi shall have exclusive jurisdiction over all matters relating to interim relief, enforcement, or any ancillary proceedings arising out of or in connection with these Terms.
